I try to understand the difference between a design patent and a utility patent. Now, say for example, the soles of his shoes Dr. Scholl's have inside somehow (design), but what about the purpose of freezing in one - a massage or create comfort for feet. This is a according to this class as a utility patent?
A utility patent may be granted to anyone who invents or discovers a process new and useful machine, article of manufacture, composition of matter or any new useful improvement thereof. A design patent may be granted to anyone who invents a new design, original and ornamental article of manufacture. For example, say that the state of the art shows that do not contain no gel insoles. Assuming no evidence, the addition of gel in the patent insole would be patentable as useful. In addition, that the insertion gel in the outsole creates a unique interior. This form can be protected as a design patent. As you can see, in some cases it there can be overlap between the utility and patent protection design. I suggest you go to the website of the Patent Office (www.uspto.gov) and get some utility patents and design patents. The design patents are those with a "D" against the patent number. Similarities / differences between the two are easy to recognize when you see some examples of real life.
